Terms and Conditions

These Terms and Conditions apply to all quotes, orders, sales, shipments, inspections, payments, returns, website use, and related services offered through GoRoostr.com and other GoRoostr-branded services.

GoRoostr is a brand operated by Go Roostr LLC, a Pennsylvania limited liability company. References to “GoRoostr,” “Go Roostr,” “we,” “us,” and “our” mean Go Roostr LLC.

By accessing our website, requesting a quote, submitting an order, sending a device to us, submitting a bulk sale request, or using our services, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, you may not use our website, submit an order, or send devices to GoRoostr.

1. Eligibility to Sell

You must be at least 18 years old to sell a device to GoRoostr.

By submitting an order or sending a device to us, you represent and warrant that:

  1. you are the legal owner of the device;
  2. you have the legal right to sell the device;
  3. the device is not stolen, lost, financed, leased, blacklisted, remotely managed, subject to a third-party ownership claim, or otherwise restricted from sale;
  4. all information you provide to GoRoostr is accurate and complete;
  5. you are located in the United States; and
  6. the device is being shipped from within the United States.

GoRoostr does not accept international orders or devices shipped from outside the United States.

2. Acceptance of Terms

You may not submit an order unless you agree to these Terms and Conditions.

For online orders, you must affirmatively accept these Terms before submission. For bulk orders, enterprise orders, or other special transactions, GoRoostr may require written, electronic, or checkbox acceptance of these Terms before processing the order.

GoRoostr may record and retain information related to your acceptance of these Terms, including your order ID, timestamp, IP address, user agent, email address, phone number, shipping information, payment information, and the version of the Terms accepted.

You are responsible for reviewing these Terms before submitting an order or sending any device to GoRoostr.

3. Quotes Are Estimates Until Inspection

All quotes are subject to inspection.

GoRoostr provides quotes based on the information you provide, including device type, model, configuration, condition, functionality, lock status, included accessories, and other relevant details.

No quote is binding until:

  1. GoRoostr receives the device;
  2. GoRoostr inspects the device;
  3. GoRoostr determines that the device matches the information you provided;
  4. GoRoostr determines that the device is eligible for purchase; and
  5. GoRoostr issues payment.

GoRoostr may revise, reduce, cancel, or refuse any quote if the device does not match the information provided, is damaged, is missing parts, is not eligible for purchase, is restricted, is unsafe, or if there is a pricing, technical, typographical, or market-based error.

GoRoostr is not responsible for pricing errors, website errors, quote calculation errors, typographical errors, product database errors, or market price changes.

4. Quote Validity

You must ship your device within ten business days from the time your quote is issued in order to maintain quote validity.

Once shipped, your device must arrive at GoRoostr within ten additional business days.

Devices shipped late or received outside these timeframes may be subject to a quote adjustment, requote, cancellation, or refusal at GoRoostr’s discretion.

Prices may change at any time due to market conditions, supply, demand, resale values, inventory levels, product condition, or other business factors.

If a device cannot be processed because of customer delay, non-response, lock status, remote management status, missing information, payment issue, return issue, or another unresolved issue for more than five business days, GoRoostr may revise, withdraw, or cancel the quote based on current market conditions.

5. Device Inspection

After GoRoostr receives your device, we will inspect it to determine whether it matches the information provided during checkout or quote submission.

Inspection may include, but is not limited to:

  1. verifying the model, serial number, IMEI, configuration, storage, processor, memory, carrier, or other specifications;
  2. checking physical condition;
  3. checking functionality;
  4. checking for missing parts or accessories;
  5. checking lock status;
  6. checking remote management or MDM status;
  7. checking blacklist, lost/stolen, financing, or third-party restriction status;
  8. testing battery health or power functionality;
  9. assessing whether the device is safe to handle, ship, erase, resell, recycle, or process.

GoRoostr may refuse to purchase any device for any lawful reason, including but not limited to fraud risk, safety concerns, misrepresentation, ownership concerns, account locks, MDM enrollment, blacklist status, financing status, market changes, or device ineligibility.

6. Ownership and Title Transfer

Sending a device to GoRoostr does not automatically transfer ownership to GoRoostr.

GoRoostr does not purchase your device until inspection is completed and payment is issued.

Title to the device transfers to Go Roostr LLC only when GoRoostr issues payment to you, unless the device is otherwise deemed abandoned, surrendered to law enforcement, recycled, destroyed, or disposed of under these Terms and applicable law.

Once payment is issued, the sale is final.

7. Requotes and Revised Offers

If your device differs from the information provided, arrives damaged, is missing parts, has condition issues, has functionality issues, or otherwise does not match the original quote, but is still eligible for purchase, GoRoostr may issue a revised quote.

You will have five business days from the date the revised quote is sent to accept or reject it.

If you accept the revised quote, GoRoostr will issue payment based on the revised amount. Once payment is issued, the sale is final.

If you reject the revised quote, GoRoostr will return the device to you at no cost for the first return attempt, provided the device is not a Restricted or Ineligible Device and is not otherwise subject to customer-paid return shipping under these Terms.

If you do not respond to the revised quote within five business days, the revised quote will be treated as rejected. GoRoostr may return the device using the return address provided with your order.

GoRoostr is only responsible for one return shipment in connection with an ordinary rejected revised quote.

8. Restricted or Ineligible Devices

GoRoostr does not purchase Restricted or Ineligible Devices.

A “Restricted or Ineligible Device” includes, but is not limited to, any device that is:

  1. activation locked;
  2. iCloud locked;
  3. Google locked;
  4. Samsung locked;
  5. passcode locked in a way that prevents inspection, erasure, or processing;
  6. BIOS locked;
  7. firmware locked;
  8. remotely managed;
  9. MDM-enrolled;
  10. blacklisted;
  11. reported lost or stolen;
  12. financed;
  13. leased;
  14. subject to a third-party ownership claim;
  15. counterfeit;
  16. materially misrepresented;
  17. not the model selected;
  18. not a device type GoRoostr purchases;
  19. hazardous;
  20. biohazardous;
  21. unsafe to handle, ship, inspect, erase, recycle, or process;
  22. otherwise ineligible for purchase.

If GoRoostr receives a Restricted or Ineligible Device, GoRoostr may refuse purchase and require you to either resolve the issue or provide a prepaid return shipping label.

GoRoostr does not cover return shipping for Restricted or Ineligible Devices.

9. Locked, Remotely Managed, Blacklisted, Financed, or Restricted Devices

If you send a device that is locked, remotely managed, MDM-enrolled, blacklisted, financed, leased, reported lost or stolen, or otherwise restricted, GoRoostr may notify you using the contact information provided with your order.

If the issue is resolved within the longer of:

  1. two weeks from your original order date; or
  2. one week from the date GoRoostr notifies you of the issue,

GoRoostr may honor the original quote, provided the device otherwise matches the quote and remains eligible for purchase.

If the issue is not resolved within that timeframe, GoRoostr may requote the device at the current market price, refuse purchase, require a prepaid return label, or handle the device under the Abandoned Devices section of these Terms.

GoRoostr is not responsible for delays, price changes, lost quote value, market declines, or processing delays caused by locks, remote management, MDM profiles, blacklist status, financing status, missing information, or customer non-response.

10. Customer-Provided Return Labels

When you are responsible for return shipping, you must provide a prepaid, trackable return shipping label from one of the following carriers:

  1. USPS;
  2. UPS;
  3. FedEx.

GoRoostr does not accept payment from customers for GoRoostr to purchase return labels. If you are responsible for return shipping, you must provide the label directly.

You are solely responsible for:

  1. the carrier selected;
  2. the service level;
  3. insurance;
  4. signature confirmation;
  5. delivery address accuracy;
  6. postage accuracy;
  7. carrier claims;
  8. delivery delays;
  9. loss;
  10. damage;
  11. misdelivery;
  12. failed delivery;
  13. returned shipments.

Once GoRoostr tenders the package to the carrier using your provided label, GoRoostr is not responsible for loss, damage, delay, misdelivery, failed delivery, carrier refusal, insufficient postage, lack of insurance, or any other shipping issue.

11. Return Shipping

For ordinary revised quote rejections, GoRoostr will pay for the first return shipment, unless the device is a Restricted or Ineligible Device or otherwise subject to customer-paid return shipping under these Terms.

GoRoostr does not cover return shipping for:

  1. Restricted or Ineligible Devices;
  2. locked devices;
  3. remotely managed or MDM-enrolled devices;
  4. blacklisted devices;
  5. financed or leased devices;
  6. reported lost or stolen devices;
  7. devices subject to third-party ownership claims;
  8. materially misrepresented devices;
  9. devices GoRoostr does not purchase;
  10. wrong models or wrong device types;
  11. hazardous or biohazardous devices;
  12. devices returned to GoRoostr after a failed delivery attempt;
  13. devices where the customer provided an incorrect, incomplete, outdated, or undeliverable address;
  14. devices where the customer refused delivery, failed to sign, or failed to claim the package;
  15. any second or subsequent return attempt.

GoRoostr may require signature confirmation for return shipments.

12. Returned Devices and Failed Delivery

If GoRoostr returns a device to you, we will send it to the address provided at the time of your order unless you provide a different return address before the return shipment is created.

GoRoostr may use the original packaging, generic packaging, or other reasonable packaging materials for return shipments. GoRoostr is not required to return original boxes, cases, screen protectors, accessories, packaging inserts, or other non-device items unless GoRoostr chooses to do so.

Return shipments may be insured and may require signature confirmation.

If a returned device is refused, unclaimed, undeliverable, returned to sender, not accepted, unable to be signed for, or otherwise returned to GoRoostr, GoRoostr is not responsible for additional return shipping attempts.

In that situation, you must provide updated return instructions and a prepaid, trackable return shipping label from USPS, UPS, or FedEx.

If you do not provide valid return instructions and a prepaid return label, the device may be handled under the Abandoned Devices section of these Terms.

13. Abandoned Devices

A device may be considered unresolved or potentially abandoned if any of the following occurs:

  1. you do not respond to a revised quote, lock notice, return shipping request, payment issue, address confirmation request, or other order issue;
  2. you fail to remove an activation lock, cloud lock, MDM profile, remote management profile, financing restriction, blacklist status, account association, password, or similar restriction;
  3. you fail to provide a required prepaid return shipping label;
  4. a returned device is refused, unclaimed, undeliverable, returned to sender, or otherwise returned to GoRoostr;
  5. you provide inaccurate or incomplete contact, payment, or return information;
  6. GoRoostr cannot complete inspection, payment, or return because of your action, inaction, or failure to provide required information;
  7. you fail to claim, retrieve, or arrange return of a device when required.

GoRoostr will make reasonable attempts to contact you using the contact information provided with your order.

If the issue is not resolved, GoRoostr may send a final notice requiring action.

If the device remains unresolved for 90 calendar days after GoRoostr’s initial notice of the issue, the device may be deemed abandoned to the fullest extent permitted by law.

After that time, GoRoostr may recycle, destroy, dispose of, donate, resell, or otherwise process the device without payment or further liability, subject to applicable law and GoRoostr’s data security, environmental, recycling, and R2v3-related obligations.

This section should be interpreted to the maximum extent permitted by applicable law.

14. Suspected Stolen Property, Fraud, and Law Enforcement

GoRoostr may refuse, hold, report, or surrender any device to law enforcement or another appropriate authority if GoRoostr reasonably believes the device is stolen, reported lost or stolen, subject to a third-party ownership claim, involved in fraud, unlawfully possessed, or otherwise unlawful to purchase or return.

If a device is surrendered to law enforcement or another authority, GoRoostr will not issue payment and will not be liable for the device’s return.

You agree that GoRoostr is not responsible for receiving, holding, reporting, or surrendering stolen, lost, restricted, blacklisted, financed, leased, or fraudulently submitted property.

15. Biohazardous, Dangerous, or Unsafe Devices

GoRoostr may refuse, return, recycle, destroy, dispose of, or otherwise process any device that GoRoostr determines is hazardous, biohazardous, unsafe, contaminated, or dangerous.

This includes, but is not limited to, devices containing or affected by:

  1. bed bugs;
  2. roaches;
  3. insects;
  4. urine;
  5. feces;
  6. blood;
  7. mold;
  8. hazardous waste;
  9. chemicals;
  10. fire damage;
  11. excessive battery swelling;
  12. leaking batteries;
  13. damaged lithium-ion batteries;
  14. punctured batteries;
  15. other unsafe or unsanitary conditions.

If a device’s battery is determined to be dangerous, swollen, leaking, damaged, or unsafe to ship, GoRoostr may be unable to return the device with the battery installed.

GoRoostr may dispose of unsafe batteries or unsafe devices in accordance with applicable safety, shipping, recycling, environmental, and R2v3-related requirements.

You may be responsible for shipping, handling, recycling, disposal, or administrative costs related to hazardous, biohazardous, or unsafe devices.

16. Packaging and Shipping to GoRoostr

You are responsible for properly packaging your device before shipping it to GoRoostr.

Any packaging instructions provided by GoRoostr are general guidelines only. You are responsible for packaging your device in accordance with the applicable carrier’s shipping standards and service guide.

You should use a sturdy box, sufficient padding, bubble wrap, fill material, and other protective packaging appropriate for the device.

GoRoostr is not responsible for devices that arrive damaged due to improper packaging.

If GoRoostr provides a prepaid shipping label, the label may include shipping insurance based on the quoted value of the device. However, carrier insurance claims may be denied if the device was improperly packaged or if carrier requirements were not followed.

GoRoostr has sole discretion over whether to file any carrier insurance claim. GoRoostr is not liable for carrier claim denials, carrier delays, carrier loss, carrier damage, or carrier refusal.

17. Payment Timing

GoRoostr generally sends payment within one business day after receiving and completing processing of your device.

Some devices may take longer to process.

Devices with issues, devices requiring additional inspection, devices with lock or account issues, and bulk orders may take up to three business days or longer.

Very large orders, enterprise orders, institutional orders, or unusual transactions may have no predefined processing timeline. In those cases, GoRoostr will communicate processing expectations directly when practical.

Payment timing estimates are not guarantees.

18. Payment Method and Payment Information

GoRoostr will send payment using the payment method you selected during checkout or otherwise agreed to by GoRoostr.

You are responsible for providing accurate and current payment information, including any mailing address, email address, phone number, account handle, bank information, or other payment destination information required for your selected payment method.

GoRoostr is not responsible if payment is delayed, misdirected, rejected, lost, or not received because you provided inaccurate, outdated, incomplete, inaccessible, or incorrect payment information.

Although GoRoostr may offer payment methods with no fees charged by GoRoostr, GoRoostr is not responsible for fees charged by banks, payment processors, apps, platforms, or other third parties.

19. Payment Issues, Delivery, and Reissues

Any claim that a payment was not received must be reported to GoRoostr within 30 calendar days of the payment sent date.

Claims submitted after this window may be denied due to payment network, banking, processor, and record-retention limitations.

For any payment dispute, you may be required to provide official documentation sufficient to verify non-receipt or payment status, including, where applicable:

  1. bank statement excerpts;
  2. transaction research results from your financial institution;
  3. written confirmation from your bank or payment provider;
  4. screenshots or account documentation;
  5. other documentation reasonably requested by GoRoostr.

GoRoostr will not issue duplicate payments if GoRoostr’s records, bank statements, processor records, transaction confirmations, or other reliable records show that payment was successfully sent and not returned.

For transactions older than 90 calendar days, GoRoostr may be unable to obtain payment network trace details, reversals, or processor records. If an aged transaction cannot be verified due to third-party record limits and you cannot provide sufficient documentation, the claim may be considered closed.

If a payment is returned or rejected, GoRoostr may contact you using the contact information on file to arrange an alternate payment method. If GoRoostr is unable to reach you or you do not respond within a reasonable time, processing may be delayed, canceled, or handled under these Terms.

20. Coupons and Promotions

Coupons, promo codes, bonuses, special offers, and promotional pricing are offered at GoRoostr’s discretion.

GoRoostr may discontinue, modify, refuse, or cancel any coupon, promo code, bonus, special offer, or promotional pricing at any time.

Coupons and promo codes are verified and honored only at the time of payout.

GoRoostr may refuse a coupon or promo code for any reason, including misuse, expiration, suspected fraud, system error, duplicate use, ineligible device, adjusted quote, or other business reasons.

GoRoostr may apply, adjust, or remove coupons from revised quotes at its discretion.

21. Device Data and Customer Backup Responsibility

You are responsible for backing up and removing any data you wish to keep before sending a device to GoRoostr.

GoRoostr is not responsible for lost files, photos, videos, contacts, messages, software, settings, accounts, licenses, passwords, app data, personal information, business information, or any other data left on a device.

You should remove personal information, log out of accounts, disable device tracking, remove activation locks, remove passwords, and back up all data before shipping your device.

As part of inspection, processing, resale, recycling, data security, or R2v3-related procedures, GoRoostr may erase, reset, sanitize, destroy, or otherwise process devices and data-bearing components.

Data erasure, reset, sanitization, destruction, or recycling may occur before or after payment depending on the device, transaction status, safety concerns, resale eligibility, recycling requirements, abandoned-device status, or applicable processing requirements.

GoRoostr performs data sanitization consistent with applicable NIST 800-88 guidelines and its R2v3-certified processes.

Data erasure or diagnostic documentation may be available upon request when applicable.

Broken, inaccessible, locked, damaged, or otherwise non-functional devices may not be capable of standard erasure. If erasure is not possible, GoRoostr may destroy or recycle the data-bearing component or device in accordance with applicable recycling, data-security, and R2v3-related procedures.

You agree not to hold GoRoostr liable for lost data, inability to recover data, account loss, data exposure caused by your failure to remove data, or any claim arising from data left on a device.

22. Bulk Orders

Bulk orders, business orders, institutional orders, or large-volume transactions may require additional inspection, processing time, documentation, pricing review, and communication.

Bulk order quotes are subject to inspection and may be adjusted based on:

  1. device count;
  2. model mix;
  3. configuration;
  4. condition;
  5. lock status;
  6. MDM or remote management status;
  7. missing parts;
  8. accessories;
  9. resale eligibility;
  10. recycling requirements;
  11. market pricing;
  12. logistics or processing complexity.

Very large orders may have no predefined processing timeline.

GoRoostr may require separate written terms, special pricing, pickup terms, inventory lists, serial number reports, chain-of-custody documentation, or other transaction-specific requirements for bulk orders.

If there is a conflict between these Terms and a separately signed written agreement between you and Go Roostr LLC, the signed written agreement will control for that specific transaction.

23. Website Use

The materials on GoRoostr’s website are provided for general information and transaction purposes.

You agree not to use the website for unlawful, fraudulent, abusive, malicious, or unauthorized purposes.

You may not interfere with the website, attempt unauthorized access, scrape data without permission, submit false information, manipulate quotes, abuse promotions, interfere with security features, or use the website in a way that could harm GoRoostr or others.

The materials on GoRoostr’s website are protected by applicable copyright, trademark, and other intellectual property laws.

24. Accuracy of Website Materials

The materials appearing on GoRoostr’s website may include technical, typographical, photographic, pricing, product, or other errors.

GoRoostr does not warrant that any website materials are accurate, complete, current, or error-free.

GoRoostr may make changes to website materials, pricing, product information, quote tools, policies, and services at any time without notice.

GoRoostr does not commit to updating all website materials.

25. Links to Third-Party Sites

GoRoostr’s website may contain links to third-party websites, services, policies, tools, platforms, or resources.

GoRoostr is not responsible for the content, accuracy, privacy practices, policies, security, availability, or actions of third-party websites or services.

The inclusion of a link does not imply endorsement by GoRoostr.

Your use of third-party websites or services is at your own risk.

26. Disclaimer of Warranties

GoRoostr’s website, quote tools, materials, services, and related information are provided “as is” and “as available.”

To the fullest extent permitted by law, GoRoostr disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and error-free operation.

GoRoostr does not warrant that the website will be uninterrupted, secure, current, accurate, or free from errors.

Some jurisdictions do not allow certain warranty disclaimers, so some disclaimers may not apply to you.

27. Limitation of Liability

To the fullest extent permitted by law, GoRoostr and its owners, officers, employees, contractors, vendors, suppliers, agents, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or similar damages, including but not limited to loss of data, loss of profit, business interruption, lost opportunity, lost resale value, device depreciation, market price changes, or third-party claims.

GoRoostr’s liability for any claim related to a device, quote, order, shipment, payment, return, website use, or service will not exceed the final quoted or revised purchase amount for the device at issue, unless applicable law requires otherwise.

GoRoostr is not liable for:

  1. customer-provided inaccurate information;
  2. improper packaging;
  3. carrier loss or damage;
  4. denied carrier claims;
  5. failed delivery;
  6. customer failure to sign for a shipment;
  7. customer failure to provide a correct address;
  8. customer failure to remove locks or accounts;
  9. customer failure to provide a return label;
  10. customer failure to back up data;
  11. market price changes;
  12. third-party payment processor issues;
  13. third-party ownership disputes;
  14. legal restrictions preventing purchase or return;
  15. circumstances outside GoRoostr’s reasonable control.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

28. Indemnification

You agree to indemnify, defend, and hold harmless Go Roostr LLC, GoRoostr, and their owners, officers, employees, contractors, vendors, suppliers, agents, and affiliates from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorney fees, arising from or related to:

  1. your breach of these Terms;
  2. false, inaccurate, or incomplete information you provide;
  3. your shipment of a device you do not legally own or have authority to sell;
  4. stolen, lost, financed, leased, blacklisted, locked, or restricted devices;
  5. hazardous, biohazardous, unsafe, or unlawful devices;
  6. third-party ownership claims;
  7. your failure to remove data or accounts;
  8. your failure to package a device properly;
  9. your violation of law;
  10. your misuse of GoRoostr’s website or services.

29. Dispute Resolution

Before filing any formal claim, you agree to contact GoRoostr and provide a reasonable opportunity to resolve the dispute informally.

Your dispute notice should include:

  1. your name;
  2. your order number;
  3. your contact information;
  4. a description of the issue;
  5. the resolution requested;
  6. any relevant documentation.

GoRoostr will review the dispute and attempt to respond in a reasonable time.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules.

Subject to any applicable small-claims rights or mandatory legal requirements, any dispute arising from these Terms, your order, your device, your shipment, payment, return, website use, or GoRoostr’s services will be brought in the state or federal courts located in Pennsylvania.

Nothing in this section prevents GoRoostr from cooperating with law enforcement or other authorities.

30. SMS Messaging Consent

By providing your mobile phone number and opting in to receive text messages from GoRoostr, you consent to receive SMS or MMS messages from GoRoostr at the number provided.

Messages may include transactional messages related to quotes, orders, shipments, inspections, requotes, payments, returns, unresolved device issues, account locks, or customer service.

If you separately opt in to marketing messages, messages may also include promotional, recurring, automated, or marketing messages.

Message and data rates may apply. Message frequency will vary.

You may opt out of marketing text messages at any time by replying STOP to a marketing message. For help, reply HELP or contact GoRoostr at info@goroostr.com.

Consent to receive marketing text messages is not required as a condition of purchase or sale.

Transactional messages related to an active order, quote, shipment, payment, return, or unresolved device issue may still be sent as permitted by law.

Carriers are not liable for delayed or undelivered messages.

31. Privacy Policy

Your use of GoRoostr’s website and services is also governed by our Privacy Policy.

By using our website, submitting an order, submitting a quote request, submitting a bulk order request, communicating with us, or sending a device to us, you agree to our collection, use, and handling of information as described in our Privacy Policy.

32. reCAPTCHA and Third-Party Tools

GoRoostr’s website may use reCAPTCHA, analytics tools, advertising tools, fraud-prevention tools, payment tools, shipping tools, customer communication tools, and other third-party services.

Your use of these features may be subject to third-party terms, privacy policies, and practices.

GoRoostr is not responsible for third-party tools, outages, errors, delays, policies, or data practices.

This site is protected by reCAPTCHA and the Google Privacy Policy and Terms of Service apply.

33. Changes to These Terms

GoRoostr may revise these Terms at any time.

The version posted on GoRoostr’s website at the time of your order, quote submission, bulk order submission, or device shipment will generally apply to that transaction, unless a later version is required by law or separately agreed to.

Your continued use of the website or services after changes are posted means you agree to the updated Terms.

34. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.

The invalid, unlawful, or unenforceable provision will be interpreted or modified to the minimum extent necessary to make it valid and enforceable, if permitted by law.

35. No Waiver

GoRoostr’s failure to enforce any provision of these Terms does not waive GoRoostr’s right to enforce that provision later.

Any waiver must be in writing and signed by GoRoostr.

36. Entire Agreement

These Terms, together with GoRoostr’s Privacy Policy and any transaction-specific written agreement signed by Go Roostr LLC, constitute the agreement between you and GoRoostr regarding your use of the website, quote submission, order, shipment, sale, payment, return, and related services.

If a separate written agreement signed by Go Roostr LLC applies to a specific transaction, that agreement will control only to the extent it conflicts with these Terms.

For custom orders, phone-assisted orders, email-assisted orders, manually created orders, or other orders created by GoRoostr on behalf of a customer, you agree to these Terms by using a GoRoostr-provided shipping label, sending your device to GoRoostr, accepting a quote, or otherwise proceeding with the transaction after receiving notice of these Terms.
